A family member passed away with no will

So the daughter has a recording of what he wanted? That will work. An attorney can run with that. Still have to go thru probate
My folks didn't do it right either and it was a mess. Manageable but a mess.

Yes she does. I'm told. I haven't heard the recording yet. If it will help, it would make things much easier.

Good luck. I've been through this and even with a will there can be snags. Attorney fees can add up very quickly. My mother died in 1999 and there is still one stock that is being held by a brokerage. I think they have to turn it over to the state she lived in as lost (unclaimed) property. My Dad lived until 2002 and had never taken ownership of her small collection of inherited stocks. I managed to get all but one transferred to his estate with very little problem. Dealing with Broadridge had been an endless game of legal BS. It's not a lot of $ so attorney fees would eat most of it up if I tried that. 70 shares of Morgan Stanley & a few $100s of "uncashed checks". I assume those would be of no value now as there is a time limit on cashing checks. I suspect those are dividend checks.

I don't know of any investments he had, but I've never been in his house to look for anything. His daughter is the one that will be looking until we 86 the brother. I met her father once a few years ago when I fixed his pickup for him. He’s my wife's daughter's father, and he didn't have any way to get to the store for food, so I took care of it for him. The daughter was very upset, so I just handled it for her.

If it had been just a few days later, there would be a will. I just downloaded a simple will for me and filled it out, and tomorrow I'll go to the bank and get it notarized.

I was the executor on my first wifes fathers estate. Never again. I spent my own money on a lawyer and God as my witness everything I edid was in the best interest of his children. Yet they let a drug dealer have the place and have hated my guts for no known reason that I can figure out. I need to personally get my butt down to the Atorneys and get a will made. I only have one living child but you can bet your ass there will be vultures out there trying to screw him out of everything. I'm just not real fond of paying someone to make what is mine someone elses. What is mine is mine and I resent the systems in place that feed off of what is rightfully mine. I have a situation with my own home where now that the origional owner has passed away there is no record that I bought it from them 40 years ago. Title company no longer has any records that far back. WTF did I pay the Title Company for 40 years ago! Tax office says I must go through a lawyer even though I've paid the taxes for 40 years. ******* paracites.

Im sorry to hear about your experience, and I hope it works out on your house.

One thing we are very concerned about is my wife's daughter will be inheriting almost half a million dollars. And when you get that kind of money your get relatives you never knew. And being 24 i'm not sure if she is mature enough to keep it to herself.

About a year ago she fell in love and gave up everything and followed a guy across the country. In a very short time he was stepping out on her. She lost $20k in total after she dumped him. And i can tell by the way she rolls her eyes when we talk about this she's not really listening.

Im hoping she takes the money and gets an education. Not much future in being a waitress at a Chinese restaurant.

Sounds like we have the same daughter. My daughter did get her Physical therapyst liscense. But her past was much like your daughters. Relationships can be killers. My youngest son took his own life at age 16. He would have been 51 last month.

I am also a retired attorney but didn't do wills and probate matters. I worked in construction claims. You need to retain an attorney where your brother lived to give you correct legal advice for that area. Every state has different laws and local courts also have their own policies/rules that have to be followed.

What typically happens where there is no will is that the court will order everything sold and then the money will be disbursed according to state law. I don't care what it costs, retain an attorney. Without an attorney you will lose far more than the cost of the attorney. People who try to be their own attorney rarely come out ahead. Our court systems is stacked against non attorneys trying to do their legal work.
