The term Airworthy is not speciffically defined in the FAR's, but it has been litigated to mean: Meets Type design and is in condition for safe flight
True, and that is by FAA Legal Department design. The closest you will get to a definition of "Airworthy" is printed on the Airworthiness Certificate.
Oh, yeah, the whole thing is; The aircraft (1) conforms to its original type design or is in a properly altered condition and (2) is in a condition for safe flight. That "properly altered" thing is very germane to this particular issue....!
